The terms for using Gate83.

1. 1.Agreement

   These terms are an agreement between you and BoardingAI, which operates Gate83 (gate83.com). By creating an account or using Gate83 you accept them. If you use Gate83 for a company, you confirm you can accept these terms for it, and “you” includes that company. You must be at least 18.

2. 2.Your account and workspace

   Keep your sign-in details safe and tell us at once about unauthorized use. You are responsible for activity in your account and for the people you invite to your workspace, including the roles you give them.

3. 3.What Gate83 does — and doesn't

   Gate83 sends synthetic travelers, designed research personas, through the websites you choose in a real browser, records what happens and produces a report.

   • The travelers are not real people. Results are research hypotheses about where different kinds of visitors may struggle; they are not statistically representative of any population and do not predict sales, rankings or conversions.
   • Reports are partly drafted by AI. We separate what was observed from what is inferred and withhold scores without evidence, but reports can still contain mistakes. Check important decisions with real people.

4. 4.Websites you test

   • Only submit websites you own or are authorized to test, and set the allowed domains accordingly. You are responsible for having that permission and for complying with the website's terms.
   • Gate83 browses read-only: it does not buy, book, apply, sign up, log in, post or submit forms. Don't ask it to, and don't point it at pages where viewing alone causes an effect.
   • We may pause or stop a run that looks unauthorized, harmful or likely to disrupt a website.

5. 5.Acceptable use

   You agree not to:

   • use Gate83 for anything unlawful, deceptive or harmful;
   • attack, overload or probe websites or systems, or try to get around security limits;
   • access other workspaces' data, or copy, resell or reverse engineer Gate83 except as the law allows;
   • put sensitive personal information (such as health or financial details about real people) into projects unless it is necessary and lawful.

6. 6.Fees and refunds

   A project costs $500 per website, plus any applicable taxes. It includes up to 5 research questions, up to 12 travelers, 3 recorded runs per traveler and up to 2 rounds, as described on What you get. Each additional website, such as a competitor, is priced as its own scope. The price shown when you order is the price that applies.

   Refunds: you get a full refund if you cancel before research starts on your project. Once journeys have been recorded, the fee is not refundable. If a project can't run because of a problem on our side, we will re-run it or refund you.

7. 7.Your content and ours

   • You keep ownership of your content: your questions, notes, client details and the reports produced for you. You let us use it only to run Gate83 for you and to keep the service secure.
   • Gate83 itself, including its travelers, persona profiles, reader modes, tasks, software and report format, belongs to BoardingAI. You may use your reports for your own business purposes, including sharing them with your clients.
   • If you send us suggestions, we may use them without obligation to you.

8. 8.Privacy

   Our privacy policy explains how we handle personal information.

9. 9.Other services

   Gate83 relies on third-party services, such as hosting, sign-in, AI model providers and, when offered, payment processing. Their availability and terms are outside our control.

10. 10.Disclaimers

    Apart from what these terms expressly promise, Gate83 is provided “as is” and “as available”. To the extent the law allows, we disclaim implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and we don't promise that Gate83 will be uninterrupted or error-free or that any result will be achieved.

11. 11.Limitation of liability

    To the extent the law allows, BoardingAI is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to Gate83 is limited to the fees you paid us in the 12 months before the claim arose.

12. 12.Indemnity

    You will defend and compensate BoardingAI for claims arising from websites you submit without permission, your content, or your breach of these terms.

13. 13.Ending the agreement

    You can stop using Gate83 and ask us to close your account at any time. We may suspend or close an account that breaks these terms or puts others at risk. Sections that by their nature should continue (such as fees owed, ownership, disclaimers and liability) survive.

14. 14.Governing law

    These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-law rules. Disputes will be heard in the state and federal courts located in Colorado, unless the law where you live gives you a right to bring them elsewhere.

15. 15.Changes

    We may update these terms. We will post changes here with a new effective date and tell account holders about significant changes in advance by email. Continuing to use Gate83 after a change means you accept it.
